6.1 Company Rights: The Service, including its design, features, functionality, text, graphics, logos, and software, is owned by Hephaestus Technologies LLC and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

6.3 Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service.

8.1 Free and Paid Services: We may offer both free and paid subscription plans. Paid features, pricing, and billing terms will be clearly disclosed before you make any purchase.

8.2 Automatic Renewal: Paid subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

8.3 Refunds: Refunds are handled on a case-by-case basis in accordance with applicable laws. Contact our support team for refund requests.

10.1 AS-IS Service: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee: We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10.3 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEPHAESTUS TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY.

10.4 Maximum Liability: IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12.1 Service Changes: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

12.2 Terms Changes: We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on the Platform and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

13.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

13.2 Jurisdiction: You agree that any legal action or proceeding relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Albany, New York, and you consent to the personal jurisdiction of such courts.

13.3 Arbitration: Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may initiate binding arbitration in accordance with the rules of the American Arbitration Association.

14.1 Entire Agreement: These Terms constitute the entire agreement between you and Hephaestus Technologies LLC regarding the Service and supersede all prior agreements.

14.2 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.

14.3 Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

14.4 Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
